SECTION 1 – ONLINE STORE & ELIGIBILITY TERMS

• Independent Reseller Disclosure: Marutharihant Trade Corp Private Limited is an independent reseller and marketplace for luxury goods, sneakers, and collectibles. We are not an authorized dealer, partner, affiliate, or representative of brands such as Rolex, Patek Philippe, Audemars Piguet, Hermès, Chanel, Louis Vuitton, Nike, Adidas, or any other brand displayed on this platform unless expressly stated in writing. All brand names, logos, and trademarks belong exclusively to their respective intellectual property owners and are used strictly for identification and descriptive resale purposes.
  
  
• Data Transmission: You acknowledge that your data (excluding payment card information) may be transferred unencrypted across networks to adapt to technical requirements. All sensitive payment details (credit cards, debit cards, UPI, net banking credentials) are processed through secure, PCI-DSS-compliant third-party payment gateways and are always encrypted during transmission.
  
  

SECTION 3 – ACCURACY OF PRODUCT DETAILS & PRICING

• Pricing Adjustments: All product prices are subject to change without prior notice.
  
  
• Product Representations: We make every effort to display product colors, conditions, textures, and images accurately. However, variations due to display monitors, digital rendering, or photographic lighting may occur.
  
  
• Grey Market / Secondary Market Sourcing: Goods sold may be sourced through authorized dealers, secondary market dealers, private collectors, or third-party consignors. Standard manufacturer warranties, repair programs, or direct brand after-sales support may not apply. Products carry only seller warranties where explicitly specified.
  
  
• Non-Investment Disclaimer: Luxury goods, sneakers, and collectibles sold by the Company are consumer goods. Discussions regarding market value, historical appreciation, or rarity are for informational purposes only and do not constitute financial or investment advice.
  
  

SECTION 4 – BILLING, PAYMENTS & ORDER ACCEPTANCE

• Payment Methods: We accept valid Indian and international payment instruments processed through authorized payment gateway partners, including UPI, Net Banking, Credit Cards, Debit Cards, and authorized EMI/Financing providers.
  
  
• Order Verification: Marutharihant Trade Corp Private Limited reserves the right to accept, decline, or limit order quantities placed per person, household, credit card, or shipping address.
  
  
• Fraud Prevention & KYC: To prevent unauthorized transactions, the Company reserves the right to request identity verification (KYC documents) or cancel orders flagged as suspicious or high-risk by our payment gateway fraud detection systems.
  
  
• Chargeback Policy: Customers agree to first contact our customer support team to resolve transaction discrepancies before initiating a payment dispute or chargeback with their card-issuing bank.
  
  

SECTION 5 – AUTHENTICITY POLICY & DISPUTE RESOLUTION

• Authentication Protocol: The Company performs commercially reasonable multi-point authenticity assessments using industry practices and provenance verification before dispatching goods.
  
  
• Authenticity Dispute Window: If a buyer disputes the authenticity of an item received, written notice must be submitted to Marutharihant Trade Corp Private Limited within seven (7) calendar days of delivery.
  
  
• Dispute Process:
  
  
  • The item must be retained in its original condition, unworn, with all security tags, serial tags, packaging, and accessories intact.
    
    
  • The Company reserves the right to inspect the item or submit it to an agreed independent authentication expert.
    
    
• Remedy Limit: If an item is determined to be counterfeit by a mutually agreed independent authority or court of competent jurisdiction, the Company's entire liability is strictly limited to the return of the item and a full refund of the actual purchase price paid by the customer.
  
  

SECTION 6 – CANCELLATION, RETURNS & REFUNDS

• Returns and refunds are strictly governed by our published Refund Policy.
  
  
• Any product showing signs of wear, physical damage, use, component replacement, or strap modification will not be eligible for return or refund.
  
  
• Approved refunds will be credited back to the original source payment method (bank account, card, or UPI) within 5 to 7 business days, in compliance with standard payment gateway processing timelines.
  
  

SECTION 7 – THIRD-PARTY TOOLS & EXTERNAL LINKS

• We may provide access to third-party tools, widgets, or external website links that we neither monitor nor control.
  
  
• Such tools and links are provided "as is" and "as available" without warranties of any kind. Marutharihant Trade Corp Private Limited shall have no liability arising from your use of optional third-party integrations or external websites.
  
  

SECTION 8 – USER REVIEWS, FEEDBACK & SUBMISSIONS

• If you send suggestions, product reviews, or creative submissions to us, you agree that we may edit, copy, publish, and distribute those materials across any media without restriction, compensation, or confidentiality obligations.
  
  
• You are solely responsible for ensuring your submissions do not violate third-party rights, trademarks, privacy, or applicable laws.
  
  

SECTION 9 – LIMITATION OF LIABILITY

• In no event shall Marutharihant Trade Corp Private Limited, its directors, officers, employees, affiliates, suppliers, or service providers be liable for any direct, indirect, incidental, punitive, special, or consequential damages (including loss of profits, lost revenue, lost data, or replacement costs) arising from the use of the Service or purchase of any product.
  
  
• The total aggregate liability of Marutharihant Trade Corp Private Limited for any claim arising out of or related to these Terms or a specific transaction shall not exceed the actual purchase price paid by the customer for the product in question.
  
  

SECTION 10 – INDEMNIFICATION

• If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be severed without affecting the validity and enforceability of the remaining provisions.
  
  
• These Terms, along with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Marutharihant Trade Corp Private Limited.
  
  

SECTION 12 – GOVERNING LAW & ARBITRATION

• Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India. Courts situated in Hyderabad, Telangana shall have exclusive jurisdiction over any legal matters arising hereunder.
  
  
• Arbitration: Any dispute or controversy arising out of or relating to these Terms shall first be referred to and resolved by binding arbitration under the Arbitration and Conciliation Act, 1996.
  
  
  • Seat & Venue: Hyderabad, Telangana, India.
    
    
  • Language: English.
    
    
  • The arbitral award shall be final and binding on both parties.
